Rather than assume every offshore site takes Texans, we tried to read each casino’s own terms on October 14, 2026. None of the 26 casinos whose terms we could read lists Texas as a restricted state, but they don’t all say it the same way: some publish a full list of excluded states, some restrict countries only, and some publish no list at all.

Texas doesn’t license any online casino, online poker site or sportsbook. The legal options in the state are the lottery, charitable bingo and raffles, betting on horse racing at licensed tracks, and bingo-based gaming at three tribal venues. So every real money casino site open to Texans is offshore. We found no case of a player being prosecuted for playing at one. What you give up is protection: no Texas regulator checks these sites or can step in if a payout goes wrong, so stick to casinos with a payout record, like the ones above. Crypto payouts are public. Here are two of ours on Etherscan, with the time, the amount and the fee. The sender shows as a third-party service, so the casino’s name doesn’t appear, which is normal.

Sports betting isn’t legal in Texas, in person or online, so Cowboys, Texans and Longhorns fans who want to bet often look offshore too. No, not in person or online. Legalizing it would need a constitutional amendment approved by the Legislature and then by voters. BetOnline, MyBookie and Bovada offer offshore sportsbooks alongside their casinos.
They’re in a legal gray area. No Texas law specifically bans them and no regulator licenses them, and they were still open to Texans in October 2026. That could change after the 2027 legislative session.
Not before 2028 at the earliest. The Legislature next meets on January 12, 2027, and casinos would need a two-thirds vote in both chambers plus a statewide vote, which likely couldn’t happen before November 2027.
Not to the state, since Texas has no state income tax. Federal tax applies to all gambling winnings, and from 2026 you can deduct only 90% of your losses, if you itemize.
